PUBLIC SPACES PROTECTION ORDER TO COVER TEST VALLEY
BOROUGH COUNCIL’S DISTRICT IN RELATION TO ANTI-SOCIAL BEHAVIOURS
What is a Public Spaces Protection Order (PSPO)?
A PSPO is an order that is enforceable under the Anti-social Behaviour, Crime and Policing Act 2014. They are used to protect the public from behaviour that is having, or is likely to have, a detrimental effect on the quality of life of those in the locality and is, or is likely to be, persistent and unreasonable.
The order addresses issues of anti-social behaviour resulting from the consumption of alcohol in the designated areas of the district edged in red in Annex 1 (Plan A and Plan B) and allows for an authorised person to require the cessation of alcohol consumption, and to confiscate alcohol and its containers in set circumstances to help prevent this. Specifically:
- A person shall not consume alcohol, or anything reasonably believed to be alcohol when required to cease such consumption by a Police Officer, Police Community Support Officer or an authorised person.
- A person shall surrender anything in their possession which is, or reasonably believed to be, alcohol or a container for alcohol when requested to do so, to and by, a Police Officer, Police Community Support Officer or an authorised person.
In addition, within the confines of Andover Town Centre, the Order also addresses issues of harassment and public urination and allowing authorised persons to require groups to disperse where their actions may result in or incite harassment, alarm or distress.
Part 2 – Specific to the designated area of Andover Town Centre
- A person shall not harass or intimidate residents, businesses or members of the public
(a) A person shall not act, or incite others to act, in an anti-social manner, that is to say a manner that is likely to cause harassment, alarm or distress to any person.
- An Authorised person may request that an individual or a group within the area defined on Plan C disperse, where they reasonably suspect any person within that group is causing, or is likely to cause nuisance, alarm, harassment or distress to any other person.
- A person is prohibited from remaining (either individually or in a group of two or more people) within the area defined in Map Annexe B after an authorised person has requested that they leave the area or disperse, this does not prohibit the individual’s right to freedom of association and speech.
- A person shall not urinate or defecate in an open public place
