Planning in Clive

For many Parish Councils, being involved in town and country planning is their single most important activity. Local Councils have a right to ask for copies of planning applications affecting their area and to express their views to the Planning Authority, in this case Shropshire Council. Ultimately the Planning Authority makes the decision on whether to grant or refuse permission for planning applications, but it must consider the Parish Council's view before it makes its decision.

Clive Parish Council receives a small number of planning applications, and you can view the Parish Council's response to planning applications on Shropshire Council's Planning Portal, as well as in the Parish Council minutes.

As the Parish Council only meets 10 times a year, there may be times where it is not possible to meet and discuss an application and submit a response before the consultation deadline. The Council has adopted a planning response delegation procedure for use in such circumstances, and this forms part of the our Scheme of Delegation.

How to find more information about applications in your area

Planning applications are all in the public domain and available to view online. You can find information on current and past applications on Shropshire Council's Planning Portal, where you can view and download application documents, and drawings. You can also view comments by neighbours, bodies such as Shropshire Highways, Conservation Officers, and the Parish Council itself.

How to share your views

If you have an opinion on an application that is due to be discussed by the Parish Council, we would encourage you to attend the relevant Parish Council meeting; there is an open forum for public participation at the start of each meeting. If you can't attend a meeting you are welcome to share your views in writing to the clerk. This helps the Parish Council in making a decision on any comments they may submit to the Planning Authority about an application. Please note, you may also pass on your thoughts and concerns about planning applications with parish councillors, however to avoid the risk of bias and pre-determination, councillors should avoid engaging in any discussions until the Parish Council meeting where the application is to be considered. 

As well as sharing your thoughts with the Parish Council you can also submit your comments direct to the Planning Authority. Parishioner comments are very helpful to Shropshire Council Planning Officers who will make the final decision, and we would encourage all parishioners to take part in the decisions surrounding future developments in our community. It is very straightforward to submit a comment on the Planning Portal, but if you need help in directing your comments, please do not hesitate to contact the Parish Council Clerk.

Material Considerations for Planning Applications

The Planning Portal advises on what is considered to be a material consideration in determining a planning application.

What are material considerations

A material consideration is a matter that should be taken into account in deciding a planning application or on an appeal against a planning decision.
Material considerations can include (but are not limited to):

  • Overlooking/loss of privacy
  • Loss of light or overshadowing
  • Parking
  • Highway safety
  • Traffic
  • Noise
  • Effect on listed building and conservation area
  • Layout and density of building
  • Design, appearance and materials
  • Government policy
  • Disabled persons’ access
  • Proposals in the Development Plan
  • Previous planning decisions (including appeal decisions)
  • Nature conservation

However, issues such as loss of view, or negative effect on the value of properties are not material considerations.

When commenting on an application you should be aware that the following areas
are not considerations:

  • No one has a right to a view from their property. We cannot control the effects of new development on the outlook from an existing property, except in the general case of residential amenity;
  • Impact on the valuation of property;
  • The cost of a development is not a material consideration, and we have no jurisdiction to protect developers from expensive projects;
  • Loss of trade or increased competition;
  • A personal interest or a civil dispute;
  • Generally speaking, personal circumstances are not a material planning consideration

Local Plan Review

Clive is a small rural parish and is currently classed as Open Countryside, however, Shropshire Council's Local Plan Review proposes to re-classify Clive parish as a Community Hub. The following link will take you to more information on the Local Plan Review.

Community Infrastructure Levy (CIL)

Developers pay a levy which can be used to support infrastructure in the community. This is intended to allow communities to grow sustainably, without vital infrastructure being overstretched.
