Proposed renewal of the lease for the West Moors Memorial Bowls Club

The West Moors Memorial Bowls Club has been part of the community since 1950 but their lease for the use of the land is now up for renewal.  The West Moors Memorial Hall is a registered charity (number 1212375) and is the landlord.  The charity wishes to renew the lease but under section 121 of the Charities Act 2011 we are obliged to invite comments or objections – this is the formal notice of that one-month consultation period.

Background

The West Moors Memorial Hall was donated the land in three parts starting in 1929.  Each of these generous donations came with very restrictive covenants which restrict the use to purposes that benefit the community.  The land cannot be sold for development or used for any purpose that is solely commercial.  The land comprises the car park, and surrounding land on which the Hall, the Social Club and the Bowls Club stand and therefore the charity is the landlord.

The Charity Commission considers that a lease is a “disposal” of the “designated” land, albeit for a period of six years, and therefore we must follow the requirements of the Charities Act.

The Recommendation of the West Moors Memorial Hall

It is the opinion of the charity that

  • the Bowls Club continues to fulfil the requirements of the restrictive covenants in that they provide a social and recreational facility for the benefit of the community of West Moors
  • the charity can renew the lease as it supports our charitable object.

The West Moors Memorial Hall invites you to submit comments on or objections to this recommendation to renew the lease.  These submissions can either be by email, by delivery or by post.
