WOLSINGHAM PARISH COUNCIL

MINUTES OF    MEETING  HELD

TUESDAY  14TH NOVEMBER   2017  

7.00 PM  TOWN HALL, WOLSINGHAM

Presentation of Allotment Trophies : Mr. & Mrs. Monkley , Phil Roden

David Sugden , Chairperson presented the trophies for the best kept allotments and congratulated the winners for their hard work , & endeavours.

  1. APOLOGIES FOR ABSENCE:  Mrs. A. Nelson
  2. TO RECEIVE QUESTIONS FROM MEMBERS OF THE PUBLIC. Mr. Ross Dow was welcomed to the meeting. Mr. Dow is a resident of Mill Race, and has concerns about the proposed skate park and the location of the skate park. A similar skate park facility is at Crook and Mr. Dow has visited the site on several occasions and has concerns that the facility is being used more by BMX bicycles than skate boards, The language from the users left a lot to be desired and there are Health & Safety issues regarding bikes speeding through the park at Glenholme. As there was no adult supervision there was the possibility of “drug dealing” and the policing of the area was inadequate.

Cllr. Savory remained silent on the matter so as not to prejudice any forthcoming planning application. Mr. Dow offered Mr Bell’s apologies as he had been called away unexpectantly.

Mr. Sugden assured Mr Dow that when funding is in place a full planning application would be submitted to the local planning authority so that all residents could have their say on the matter, and the Parish Council would continue to involve the community on developments, within the Parish. The question of ongoing maintenance costs / insurance etc. would be addressed in the fullness of time.

  3. MINUTES OF  MEETING HELD 10TH October  2017 , moved and agreed as a true record and signed as such.
  4. MATTERS ARISING : Review of Agenda and Practices , these were gone through and at this point in time no changes were proposed.

Strategic Development Plan, a very interesting debate followed and it was agreed to look at the objectives of the Parish Council as listed on the website , as a starting point , to ascertain  the effectiveness of the Parish Council.

Cllr.John Norman wished to have his name recorded as being against this course of action.

  1. CORRESPONDENCE: CDALC: General Data Protection Regulations would come into effect 25th May 2018 and systems and procedures and a  Data Protection Officer to be appointed as follows:

General Data Protection Regulations

1.General Data Protection Regulations come into effect 25 May 2018

2.Applies to all businesses and government bodies handling data about EU citizens.

3.We MUST have a ‘Data Protection Officer’ who is INDEPENDENT of the organisation, to oversee our actions. DCC are seeking an arrangement to have one DPO for all parish councils in the county.

4.Applies to ALL personal data held in digital format, and could apply to paper records too if requested.

5.Principles;

a.Data must be held “lawfully”, which means that we need specific consent, including why it is held, for how long, and how it is processed.

b.Data can only be used for the specific purpose it was obtained for.

c.Relevant data; only data which is essential to that task can be held.

d.Accurate and up to date; must be updated as appropriate.

e.Retention; only as long as is necessary for the purpose.

f.Must be processed securely.

g.Accountability; remains with the data controller, even if process is carried out by a different data processor.

6.Any breach of data security MUST be reported within 72 hours to ICO and to the subjects involved.

7.Significant fines (up to 4% of annual turnover) for significant breaches. 

8.We should have a policy which shows how we deal with these responsibilities. This might include the encryption of any stored data, so that loss or theft is protected against. A draft protocol will be supplied soon by DCC.

9.Data can only be retained as long as is necessary to the purpose, so policy must include the deletion of data. For example, CCTV is retained for crime prevention and detection purpose, so should be deleted after (say) 28 days, unless it has been identified for evidence. We can decide how long to keep data, but must then be able to justify that decision.

10.Individuals can request a copy of ANY data we hold on them (including CCTV!)

11.Data backup should also be kept securely and encrypted.

 

Conclusions;

We need to avoid keeping any personal data as much as possible. (We keep very little.)

We need to adopt a Data Protection Policy before 25 May 2018, based on the draft which we shall receive.

We need to appoint a Data Protection Officer.

 

 

CDALC: Model Code of Conduct insertion of clause( 3)  He/She shall not behave in a manner which a reasonable person would regard as likely to bring the Council, or his/her office as a member of the Council into disrepute. Agreed to accept recommendation and include in Code of Conduct.

Mr. J. Bell, Strandfield re proposed skate park , a further  email had been received the day of the meeting and although circulated at the meeting , there was insufficient time to fully digest the contents , however the Chair would respond in due course , after having consulted fully with other members of the Parish Council, before replying.

Weardale Flower & Garden Club : re bulb planting , agreed to allow the bulb planting to proceed.

Wolsingham W.I. request to hang W.I. Centenary Banner in  Town Hall , agreed to the request.

  1. RECREATION GROUND: Gate to Outdoor Gym repositioned to open inwards. Other gate springs had now “ worn in “ and were now able to use.

Offer of Grant (in Principle) £40k  Sport England proposed skate park, this was welcome news and further information requested by Sport England would be submitted, to secure the grant.

  2. ALLOTMENTS
  3. TOWN HALL:    The Air conditioning unit had been installed.

The painting of the windows was nearing completion.

  1. MARKET PLACE: The Christmas Market had been very well attended and a great deal of fund raising had taken place. The weather had been good and the whole event was very well attended, and congratulations must go to Cllr Savory for again organising such a good community event.

The Remembrance Day Service had been well attended and thanks were forthcoming for the provision of chairs on the day and having the flag flying

  1. ANGATE STREET TOILETS :
  2. DEMESNE MILL:  Some tree works had taken place to trees adjacent to St. Anne’s Drive with full planning permission, ivy had been stripped back from the retaining wall and was in need of attention, this would be undertaken by the residents of St. Anne’s Drive.
  3. THORNLEY WOOD :Community Planting Day  2nd December  (420 trees) Durham Wildlife Trust would be hosting this event and once planted the wood would be fully planted. Some concern from residents of Thornley had been reported regarding the car park. There was a perception that it may encourage fly tipping and other activities and had not been wholeheartedly welcomed, by Thornley residents. As there was now a representative from Thornley on the Council , the situation could be monitored more fully.
  4. FOOTPATHS  Clerk to contact Tow Law Town Council regarding footpath maintenance of path leading from main road to Thornley Wood. There were in fact two paths one which was passable and the other less so. Footpaths 154 and 155.

  6. NEWSLETTER Skate Park developments, Allotment winners, Christmas Market , Remembrance Day Service.
  7. CLERKS BUSINESS:
  8. MEMBERS REQUEST: Cllr. Norman requested a litter bin at Whitfield Place on behalf of Mrs. M. Shepheard, Cllr. A. Savory to action.

It had been noted that a review of education provision would be taking place by Durham County Council in Wolsingham and Weardale and two other areas in East Durham and  had been mentioned in the local press, which was giving great concern to residents. Cllr Savory declared an interest as she was a member of DCC , but responded by informing the meeting that a full review was taking place for education provision from 0 – 19 year olds , and there had been no mention of school closures , and would be debated more fully at the cabinet meeting to be held 15th November.
